================================================================================ PERSONAL USE LICENCE Photography by Tracey Wong — traceywong.com ================================================================================ This licence is granted by Tracey Wong ("the Photographer") to the person or household that purchased the digital file ("the Licensee"). It takes effect on the date of purchase. Your order confirmation email and download page together serve as proof of purchase and as the record of which image this licence covers. Retain a copy of this document with your order confirmation. -------------------------------------------------------------------------------- 1. WHAT YOU ARE BUYING -------------------------------------------------------------------------------- You are buying a licence to USE the photograph. You are not buying the photograph itself. Copyright in the image remains with the Photographer at all times, as it does under the Copyright, Designs and Patents Act 1988. The licence granted is: - Non-exclusive — the same image may be licensed to other people. - Perpetual — it does not expire, provided you keep to these terms. - Worldwide — it is not limited to any country. - Non-transferable — it belongs to you and cannot be sold, sub-licensed, assigned or given away. -------------------------------------------------------------------------------- 2. WHAT YOU MAY DO -------------------------------------------------------------------------------- a) Print the image, at any size, for display in your own home or in a private space you occupy. There is no limit on the number of prints you make for your own use. b) Use the image as a screen background, wallpaper or lock screen on devices you own. c) Post the image on your personal social media accounts, personal blog or personal website, provided the account or site is not monetised and is not promoting a business, product or service. Credit is appreciated in the form "© Tracey Wong — traceywong.com" but is not required. d) Give a single printed copy as a personal gift, provided no money changes hands for the print itself. e) Make one backup copy of the file for your own archival purposes. f) Crop the image or make minor tonal adjustments for the purposes of framing or fitting a display, provided the result is not presented as the Photographer's own work. -------------------------------------------------------------------------------- 3. WHAT YOU MAY NOT DO -------------------------------------------------------------------------------- a) Any commercial use whatsoever. This includes advertising, marketing, promotion, packaging, editorial use in a paid publication, use on a business website or business social media account, use in a product you sell, or use by or on behalf of any company, charity or organisation. If the use touches money or a brand in any way, you need the Commercial Use Licence. b) Resell, redistribute, share, licence, lend or transfer the digital file to anyone else, whether or not for payment. This includes uploading it to stock libraries, print-on-demand services, NFT platforms, file-sharing services, or any public repository from which others could download it. c) Sell prints, canvases, merchandise or any other physical or digital product incorporating the image. d) Use the image, or any part of it, to train, fine-tune, or otherwise develop a machine-learning or artificial-intelligence model or dataset. e) Claim authorship of the image, or remove, obscure or alter any copyright notice, watermark, signature or embedded metadata. f) Alter the image so substantially that it becomes a derivative work offered as your own, or combine it into a composite that is then published commercially. g) Use the image in any way that is unlawful, defamatory, pornographic, or that would associate a person, place or property shown in the image with a controversial subject in a way likely to cause offence or reputational harm. h) Register the image, or any work derived from it, as your own trade mark, logo or design. -------------------------------------------------------------------------------- 4. NO MODEL OR PROPERTY RELEASE -------------------------------------------------------------------------------- Unless the Photographer has confirmed otherwise in writing, no model release or property release has been obtained for any person, building, artwork, signage or trade mark appearing in the image. Under this Personal Use Licence that is usually of no consequence, because personal display does not require one. It is nonetheless your responsibility to ensure your particular use complies with the law where you are. -------------------------------------------------------------------------------- 5. DELIVERY AND REFUNDS -------------------------------------------------------------------------------- The image is delivered as a full-resolution digital file by download link. As this is a digital product delivered immediately, the right to cancel under the Consumer Contracts Regulations 2013 is waived at the point of download, and the sale is final. If the file is corrupt, will not download, or is not the image you ordered, contact the Photographer and it will be put right or refunded. Download links are time-limited. Save the file when you receive it. -------------------------------------------------------------------------------- 6. TERMINATION -------------------------------------------------------------------------------- This licence terminates automatically if you breach any of its terms. On termination you must cease all use of the image, destroy all digital copies in your possession, and remove it from any website or account under your control. Termination does not entitle you to a refund and does not limit any other remedy available to the Photographer. -------------------------------------------------------------------------------- 7. LIABILITY -------------------------------------------------------------------------------- The image is provided as-is. The Photographer's total liability under this licence, for any cause, is limited to the amount you paid for the licence. Nothing in this licence excludes liability for death or personal injury caused by negligence, or for fraud. -------------------------------------------------------------------------------- 8. GOVERNING LAW -------------------------------------------------------------------------------- This licence is governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising from it. -------------------------------------------------------------------------------- 9.
